Terms of Service
Effective April 25, 2026
1. Who we are
Chromabooth-Pro is a product of Excogito Promethean LLC, a Florida limited liability company with its principal place of business at 7401 4th Street North, Suite 300, St. Petersburg, FL 33702, United States ("Chromabooth-Pro", "we", "us"). Contact us any time at hello@chromabooth-pro.com.
2. What you can do with Chromabooth-Pro
When you purchase a license or subscription you may install and run Chromabooth-Pro on the number of devices included in your tier (Event: 1 device for one event; Pro: up to 3 active devices; Enterprise: as agreed in your order). You may use captured photos and videos for your own events, your clients' events, and your own marketing.
3. What you may not do
- Reverse-engineer, decompile, or attempt to extract the source code.
- Resell, sublicense, or rebrand the software without a written agreement.
- Use the software for unlawful capture or distribution of images.
- Share your license key with operators outside your organization.
4. Subscriptions, billing, and renewals
Pro subscriptions renew automatically each month or year until cancelled. You can cancel any time from your operator portal — your subscription keeps working until the end of the paid period. Event licenses are one-time purchases and do not renew. All prices are listed in US dollars (USD) and exclude any applicable sales tax or VAT, which is calculated and collected at checkout based on your billing location.
5. Refunds
See our Refund Policy for the full details. In short: new Pro subscribers can request a 50% refund within 14 days; Event licenses are fully refundable up to 7 days before the event and 50% refundable inside that window.
6. Your content
Photos, videos, branding, and backgrounds you upload remain yours. We do not claim ownership and we do not use your event media to train AI or for marketing without your written consent. You are responsible for obtaining consent from the people who appear in photos captured at your events.
7. Service availability
Chromabooth-Pro is provided "as is" and we don't guarantee uninterrupted operation. We aim for 99.5% uptime on cloud services (license validation, AI restyle, archive sharing, QR delivery). The booth runs in your browser and requires an active internet connection at the venue — we recommend a reliable Wi-Fi or mobile hotspot for every event.
8. Liability
To the maximum extent permitted by law, our total liability for any claim related to the software is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages such as lost revenue, lost data, or business interruption.
9. Termination
You may stop using Chromabooth-Pro any time. We may suspend or terminate accounts that breach these terms, with notice where reasonable. On termination, your right to use the software ends but your captured event media remains yours.
10. Changes
We may update these terms occasionally. Material changes will be announced by email to active operators at least 30 days in advance. Continued use after changes take effect means you accept the updated terms.
11. Governing law
Chromabooth-Pro is operated from the State of Florida, United States, and is offered globally. These terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute that cannot be resolved informally will be brought before the state or federal courts located in Florida, and you and we consent to their exclusive jurisdiction. Nothing in this section limits the mandatory consumer-protection rights you may have under the laws of the country where you reside.
